The eligibility for appearing in LLB Hons for 5 years is you completed Intermediated, but if you have graduation degree then there is no problem whatever your % in graduation does not matter.But it is necessary to qualify entrance exam for LLB Hons.
you are not eligible to apply for Bachelor of law (llb) hons which is for 5 years because you have scored 40.23% as it requires a minimum percentage of 50% in graduation.

Yes, you can

The eligibility criteria is that you should have a B.A / BSc / B.com degree with a minimum of 40% marks in aggregate and 35% for SC/ST candidates. There is also a 2% Weightage for the post graduate degree holders. All the best
