Income during last 3 years, consists of one year pension below 8 lacs and the Service salary above Rs 8 lacs, during previous 2 years before retirement. Whether this is to be considered as Creamy layer or non creamy layer?

No, you are not eligible for Noncreamy layer certificate since the annual income is above than the maximum limit i.e., 8 Lacs INR. The Eligibility criteria for getting reservation are :-

-> Parents are not directly recruited Class1 (Group A) or Class2 (GroupB)
officers OR they do not occupy any constitutional posts you are most
likely to fall under Non-Creamy Layer OBC.

-> If your parents are not employed by the government, their income should
be within the limits by the government to be treated as Non-Creamy Layer
OBC.

Yes, you are eligible for reservation under non creamy layer of Other Backward Class. Candidates whose parent's income per year is less than 8 lacs per annum are eligible for reservation under non creamy layer.

If you belong to OBC then you are under non creamy layer of this class.

Pension has nothing to do with creamy or non creamy layer.

Recently, government released a notification that any aspirant whose parent's annual income is less than 8 lakhs per annum falls under non creamy layer of Other Backward Class.

As per details mentioned by you, you are under non creamy layer. Only candidates belonging to non creamy layer can avail advantages of OBC reservation.

Re: Family dependent on pension belongs to OBC Creamy or Non-Creamy Layer?

The dividing income for creamy and non creamy layer of candidates is 8 lacs per annum. It means that candidates whose father income is more than 8 lacs per annum are considered under creamy layer and not eligible for reservation benefits.

You belong to OBC non creamy layer and hence eligible for reservation benefits. It is calculated on income not on pensions.
