Is it comulsory to pass NET for Associate Professors appointed between 2001-2009?

This question is with reference to recent judgement given by Supreme Court. I have not qualified NET but I am Ph D holder (in 2000) I was appointed as an Assistant Professor in 2003 & got selected in the same institute as Associate Professor (not under CAS but a regular post filled through advertisement) in 2013. Now as per the SC decision, all those have appointed before 2009 need to pass NET. So will it be applicable to also? Kindly give me your expert opiniion. Thanks & regards.

The Supreme Court's judgment on the compulsory NET for Associate Professors appointed between 2001-2009 is still being debated. Some people believe that the judgment should be applied to all Associate Professors who were appointed during that time period, regardless of whether they have a Ph.D. or not. Others believe that the judgment should only be applied to Associate Professors who do not have a Ph.D.
If you are an Associate Professor who was appointed between 2001-2009 and you do not have a Ph.D., you should consult with an attorney to see if the Supreme Court's judgment applies to you. You should also contact your university to see what their policy is on the matter.
Here are some of the arguments for and against applying the Supreme Court's judgment to all Associate Professors who were appointed between 2001-2009:
Arguments in favor of applying the judgment to all Associate Professors:
  • The Supreme Court's judgment was based on the principle of equal opportunity. All Associate Professors should be required to pass the NET, regardless of whether they have a Ph.D. or not.
  • The Supreme Court's judgment was based on the principle of merit. The NET is a test of merit, and all Associate Professors should be required to pass it in order to demonstrate their merit.
Arguments against applying the judgment to all Associate Professors:
  • The Supreme Court's judgment was not specific to Associate Professors. The judgment was based on the principle of equal opportunity for all teachers, not just Associate Professors.
  • The Supreme Court's judgment was not based on the principle of merit. The NET is a test of merit, but the Supreme Court did not specifically say that the NET should be used to determine who is qualified to be an Associate Professor.
Ultimately, the decision of whether or not to apply the Supreme Court's judgment to all Associate Professors who were appointed between 2001-2009 is up to the individual universities. However, if you are an Associate Professor who was appointed during that time period and you do not have a Ph.D., you should consult with an attorney to see if the judgment applies to you.
Do you have any question? or have anything to say?
