How to get migration certificate if the school is denying to give it?


One of my relatives has completed his 10th from a school in Noida which is affiliated to cbse board and now, due to some reasons he has to take admission in Bihar. But his previous school is not providing the migration certificate.Due to which he is not getting admission anywhere in Bihar. What should be done now?

Private schools cannot withhold issuance of any degree or certificate of any student.

If you are not getting migration certificate , you must first meet the principal of school and request the migration certificate , you may also ask them to give in writing , why they are not providing migration certificate.

Then wait for sometime, inspite the school doesn't issue , you may issue a legal notice to school authorities asking them to issue migration or any other certificate.

To get the Migration Certificate you can meet the school principal in person and request them for the same and ask the school to give you in writing why they are not giving you the certificate. If still the certificate is not issued file the affidavit with the same facts before the new school and ask for an exemption. If they agree it is well and good, otherwise you can file a case on your previous school before a civil court of local jurisdiction or can approach a high court directly as the right to education is a fundamental right under the constitution of India.

Another option is the same issue you can bring to the notice of the deputy director of public instructions or the block education officer and they should take action as per the classification control and appeal CCA rules.
