Eligibility for CBSE board exam 2022:-

It is not the CBSE who decides the minimum or maximum age limit criteria to appear for standard 10th board examination.
The age limit criteria varies with state. It is the Directorate of State Education which decides the age limit for the specific state.

There is no official notification with respect to age limit by the CBSE board. It is the Directorate of State Education which decides the age limit criteria for candidates of the respective state. So, you can visit the concerned office or your school administration for the detail information.

First thing I would like to let you know is that CBSE does not ask for a minimum age for appearing in the Class 10th board examination explicitly for all it's student around the country rather it simply follows the minimum age criteria set by concerned state board of education in which the candidates school is located.

As your son is currently reading in Class 9th, so he will be probably appearing in CBSE Class 10th board examination in March 2024 and therefore being born on 2nd January 2008 his age will be over 16 years by March 2024 which means he will not face any issues related to his age for appearing in CBSE Class 10th board as in general minimum age for appearing in Class 10th board examination under different state education varies between 14 years to 14 years and 6 months.

For FAQs related to CBSE board examination eligibility, you can refer to the link http://cbseacademic.nic.in/web_mater.../2016/FAQs.pdf.
