Been there, done that. Residents of one town can now add earthquakes to the list.The people of Jones and other rural communities in eastern Oklahoma County and western Lincoln County, in the central part of the state, have been experiencing what geologists refer to as an earthquake “swarm” over the past year.Relative to the temblors that recently struck Haiti and Chile, these quakes have not been very strong — ranging in magnitude from 1.5 to 3.8, and yet many have been big enough, not only to be felt, but to rattle houses and rattle nerves.”It was just ka-boom!” said Jenifer Reynolds, describing one of the first tremors she felt at her Jones home last year. “And it shook the windows and shook the house.”Reynolds and her husband, Chris Cook, said they’ve personally felt about a half a dozen quakes like that — not strong enough to seriously scare them, but enough to scare their animals.”Ya know, horses take off running, and dogs are running off the porch, ya know, it’s kind of.. of that magnitude, ya know,” Reynolds said.At Shuff’s Main Street Grill, a local lunchtime mainstay, the seismic activity is a popular topic of conversation.”It’ll rock ya pretty good,” said Vic Walker, a lifelong resident of the area.And among the patrons, there’s no shortage of ideas on what could be causing the earthquakes. They range from the ridiculous to the sublime.”A bunch of gophers,” laughed Buddy Moseley;”The only theory that I have is that it’s a Biblical statement,” ventured Buddy’s wife, Grace.A popular theory that’s also circulating is that the earthquakes are the result of increased oil and gas drilling in the state.Rather than speculate on a cause, the Oklahoma Geological Survey is researching the quakes and trying to come up answers, based on facts, and the facts surrounding the seismic swarm are fairly startling:- between 1977 (when Oklahoma modernized its seismic monitoring system) and 2008, there were a total of 28 earthquakes in Oklahoma and Lincoln Counties; a rate of less than one earthquake per year.- since the start of 2009, there have been 134 earthquakes recorded in those same counties; a rate of 95 per year.To make sense of this increase, OGS brought in Austin Holland, a PhD candidate at the University of Arizona and a research seismologist.For Holland, the first order of business was to get better location data on the quakes, which required that he set up temporary seismic stations in and around the area of seismicity. The U.S. Geological Survey lent him 10 new accelerometers, which have been deployed and whose recordings Holland can access through a link on his computer.Such a network of seismic monitoring stations and the data they providedwere critical in unraveling a similar mystery a year ago in Texas.On Halloween night, 2008, residents around the Dallas-Fort Worth airport began experiencing a series of tremors — the first felt earthquakes in that area since 1950. Geologists from Southern Methodist University and the University of Texas were intrigued and decided to take a closer look.Dr. Brian Stump, a professor Earth Sciences at SMU, said the seismic equipment they put in place showed them something extraordinary about the epicenters of the earthquakes they recorded.”They all locate in that little square,” Stump said, pointing to a spot just south of the Dallas-Fort Worth airport.And that square, he said, was right along a known fault line, and right next to a wastewater injection well.Stump and other geologists said production wells have not been tied to earthquakes, but disposal wells, where the saltwater and other fluids used in oil and gas production are injected back into the earth have been shown, in some cases, to cause small quakes.”Fluids of all kinds, when they’re injected underground, do, in some cases, induce small earthquakes,” Stump said.Stump said they also learned that the injection well in question has started putting fluids into the ground just a few weeks before the DFW quakes began.”And so, as we finished the study,” Stump said, “we can’t be absolutely sure that’s the cause, but the timing and locations and things seem to say at least we should consider that as a possibility.”The resulting peer-reviewed paper got plenty of attention, including Holland’s.”We’ve looked at the saltwater disposal certainly as a possible theory,” Holland said.By far, the highest volume disposal wells in the area of earthquakes belong to Tulsa-based New Dominion, LLC. They pump, on average, 3.5 million gallons of saltwater a day into the Arbuckle formation, along a fault known as the Nemaha Ridge.During a visit to their facilities recently, we asked if they thought they could be causing earthquakes.”Well, we didn’t think we were,” said Roland Rollins, a New Dominion supervisor, “but we sure didn’t want to be the cause of it, so that’s why we thought, well we’ll just take the positive approach and find out.”With the help of OGS, the company installed two seismic stations on its property in south Oklahoma City, but the wells are 10 to 15 miles from the general location of all the earthquakes, and the monitors are not picking up any unusual seismicity, so Holland has pretty much ruled them out.But what about other injections wells? Holland said he’s looked and the ones closest to the seismic activity are all low-volume and low-pressure. What’s more, he said, the earthquakes, unlike those in Dallas a year ago, are spread out.”If it was triggered seismicity, you’d expect the earthquakes all to be located in a fairly small spatial area,” Holland said.And still, you don’t have to be a skeptic to wonder how a 10,000 percent increase in seismic activity could not be triggered.So we asked Holland if he would have a problem saying the earthquakes were tied to oil and gas activity, if the data pointed to that.”No,” Holland emphasized, “that would be very important…[but] I just can’t make the connection, there just doesn’t seem to be a link, and it’s the easy answer. Everyone wants to pin it on the oil activities, but it just doesn’t seem to be there yet.”Whether the earthquakes are induced or somehow the work of nature, they are taking a toll, as many people, like Jenifer and Chris, are now paying for earthquake insurance.”For the most part, it’s become kind of just part of life, but you would kind of like to know what the answer is,” Reynolds said.Holland said he hasn’t completely ruled out the possibility the quakes are induced (man-caused), saying he still has much more analysis to do. Self-monitoring includes keeping a record of the readings so a physician can determine if your blood pressure medicine is working effectively or needs tweaking. Left uncontrolled, high blood pressure can lead to stroke, eye and kidney damage, heart disease and disability.Exactly how home monitoring keeps blood pressure levels low isn’t clear, Balk said. “Likely reasons are improved monitoring and tailored treatment of blood pressure by both the clinician or nursing staff and the patient, and increased incentives to control one’s diet and increase physical activity,” he said. “But these explanations are purely conjectural.” Also, it isn’t clear to what degree additional support enhances the benefits or which methods of additional support are best, Balk said.”An important caveat is that the evidence refers to self-monitored blood pressure used in conjunction with clinicians and/or nurses who are using and monitoring the information,” he said. The results don’t apply to people who decide on their own to measure their blood pressure at home without consulting medical professionals, he said.The findings support current health care guidelines, said Dr. Gregg Fonarow, a professor of cardiology at the University of California, Los Angeles, and a spokesman for the American Heart Association.”National and international guidelines, including those from the American Heart Association, recommend that patients with hypertension measure and monitor their blood pressure in the home setting, and a number of studies have shown this can result in better blood pressure control,” he said.”These findings … highlight the importance of actively engaging patients in the measuring, monitoring, goal achievement and goal maintenance of their blood pressure,” he said.Blood-pressure-monitoring devices available in drugstores and other shops range in price from $30 to more than $100.When choosing a device, the American Heart Association recommends an automatic, cuff-style, upper-arm monitor. Wrist and finger monitors are not recommended because they yield less reliable readings. Monitors for the elderly or pregnant women should be validated specifically for those purposes.For the current report, Balk’s team reviewed 52 published studies in which patients monitored their blood pressure with and without assistance. Such help ranged from educational materials to contact with a nurse or pharmacist or counseling over the telephone.They found some evidence that monitoring blood pressure at home improved control at six months, but not at 12 months.When patients got help, either through educational material or direct contact with medical professionals, home monitoring improved blood pressure control at both six and 12 months.From this data, Balk’s group concluded that home blood pressure monitoring is effective in the short term. All rights reserved.Ted Parmigiani, a research analyst, was fired by Lehman Brothers in 2005, after he upgraded a company called Amkor from Sell to Neutral. He discussed his upgrade on the firm-wide squawk box at 10am on June 1, and it seems that he was hoping that his upgrade would move the market. He was disappointed: while Amkor did rise that day, it rose before his 10am call, rather than after it. Convinced that the early-morning move was attributable to Lehman insiders and their clients buying Amkor with foreknowledge of his upgrade, Parmigiani started a series of complaints.First, Parmigiani complained to Lehman superiors; that just got him fired. So he filed a wrongful-termination suit, which got settled out of court. And with his suit behind him, Parmigiani kept on complaining about what had happened. First he went to the SEC, which looked into his allegations and found no evidence of wrongdoing. After striking out with the SEC, Parmigiani complained to Senator Charles Grassley, and also to Preet Bharara, United States attorney for the Southern District of New York. Again, nothing. Finally, with nowhere left to go, and despite the fact that Lehman went spectacularly bust back in 2008, Parmigiani went to Gretchen Morgenson, some seven years after the events in question happened. And this time, he got results, if by “results” you mean a big in the New York Times.I’ll let Morgenson explain what Lehman is supposed to have done wrong:Mr. Parmigiani says traders there were routinely advised of changes in analysts?? company ratings before those changes were made public. That way, Lehman could profit on subsequent market moves. Here is how he describes it: First, research officials tipped off the traders; then Lehman??s proprietary trading desk, which cast bets with the firm??s own money, positioned itself accordingly. Lehman salespeople also alerted favored hedge funds. Only later, he says, were ratings changes made public.I have to admit that I’m a bit confused with what exactly Morgenson means by the phrase “made public”. I, for one, never had access to Lehman Brothers squawk-box calls, and I’ve never seen sell-side upgrades or downgrades filed with the SEC or be made subject to .Now it’s true that the SEC does consider the news that an investment bank is going to change its rating on a stock to be material nonpublic information, and therefore subject to insider-trading rules. But it’s a very weird, grey-area sort of inside information. Let’s say Lehman upgrades Amkor: is that inside information about Lehman, or is it inside information about Amkor? The news would be very unlikely to affect Lehman stock, so it’s not really the former. But at the same time, no Amkor insiders are involved at all, so it’s hard to see how it can be the latter.There can’t and shouldn’t be any rule against analysts doing independent analysis on companies, based on publicly-available information. Similarly, once that analysis has been done, the analyst can do what she likes with her analysis. She can trade the stock, she can write it up, she can talk to hedge funds about what she thinks, she can sell it to clients, she can make it public. Or, she can do all of the above, in any order she likes.The tricky thing happens when that analyst gets a job at an investment bank, and the individual’s analysis mutates into being the bank’s analysis. There’s a kind of invisible special sauce which a bank pours onto its analysts’ reports: if Joe Schmo puts out a “buy” rating on XYZ Corp on Seeking Alpha, few people will notice or care. But if Mr Schmo gets a job at Goldman Sachs, then that rating can move XYZ shares. And at that point, the SEC starts getting interested.Now the SEC does not say that banks need to make their research reports fully public. In its against Goldman Sachs “huddles”, for instance, the SEC has no problem with news of upgrades and downgrades being “disseminated broadly to all clients of the firm”. There’s a huge difference, of course, between the set of Goldman Sachs clients and the set of public-company investors, but as far as the SEC is concerned, it seems that if all of Goldman’s clients have a certain piece of information, then that piece of information can be considered to be public information.Similarly, Morgenson and Parmigiani seem to think that once a call has been made on the Lehman Brothers squawk box, that too counts as public information. If something’s available — in theory — to any Lehman client, then it’s public. If it’s only available to select Lehman clients, then it’s inside information.Here’s Morgenson:While insider trading commonly involves nonpublic corporate information, advance warning on research changes can also yield quick, illicit gains. The S.E.C. said as much in 2007 involving an executive at the Swiss banking giant UBS. In that case, eight individuals and three hedge funds were charged with profiting on tips about coming analyst ratings changes ?? ??valuable and material, nonpublic information,?? the S.E.C. said. One executive went to jail, and others settled with the S.E.C.This is disingenuous. The case in question involved individuals, not the bank as a whole: a UBS executive director, Mitchel Guttenberg, was personally tipping off his friends, in return for under-the-table payoffs, about upcoming UBS upgrades and downgrades. In that sense, the case is really about misappropriation rather than about insider trading. As explains, using the example of :An employee??s undisclosed and self-serving use of information belonging to his employer to trade securities is a securities fraud. The employee is ??misappropriating?? the information from his employer and using it for his own personal gain??If the Wall Street Journal had authorized Winans to leak to his roommate and his stockbroker, no violation would have occurred. In that case, there would be no breach of duty to his employer, which means there??s no misappropriation.In other words, as far as I can tell, no one has ever been successfully prosecuted for the crime that Morgenson and Parmigiani are so upset about here — the crime of giving information about ratings actions to some clients before other clients. The Goldman huddle case, in particular, seems particularly thin: the SEC is basically shocked — shocked! — that before an analyst upgraded a company, that analyst was bullish on the company in question. Whereas the rest of us would probably be shocked if an analyst wasn’t bullish before upgrading a company. And in the end, the Goldman huddle case was more about internal controls than it was about inside information.The fact is that if no corporate insiders are involved, there’s really no good reason at all to prosecute or criminalize anybody using information they’ve obtained to act in the markets. The markets should be a game of people using independently-obtained information and analysis to make their own determinations about what various securities are worth — that’s the best way to maximize the amount of information reflected in the price of those securities.As the Facebook IPO demonstrated, pricing securities, especially stocks, is always more of an art than a science. Facebook’s underwriters thought they had a pretty good handle on where the demand was for Facebook’s stock, but they were wrong: all those investors were deliberately upsizing their orders just because they knew they wouldn’t get all the shares they were asking for. And because they also reckoned they could lock in a nice profit by selling some of their shares at the very first tick. By the end of the day, Facebook’s banks were being forced to buy back stock, in significant quantities, at the same price they’d sold it.So let’s let brokerages’ clients trade what they like, so long as they’re not trading on genuinely inside information from the company in question. If we’re going to be serious about the Volcker Rule, and prevent the brokerages from trading for their own account, the least we can do is let them monetize their analysts’ research as best they can.Do sellers have to tell you about problems in their home that you can’t see? The answer, generally speaking, is yes, and most states require the seller to deliver this disclosure in writing, via a completed “seller disclosure” form.Most states require sellers (even those selling “by owner”) to disclose major defects known at the time the form is completed. If the seller has fixed a problem, the seller might indicate that he is “unaware” of a material defect relating to the home. But if the seller has repeatedly repaired the same problem, he should disclose this problem and indicate what has been done to take care of it.Buyers should carefully review the seller disclosure form to see if the seller checked off any item to disclose a defect. If there are items checked off, hire a professional home inspector or other professional to investigate the situation further. If you’ve already had an inspector tour the home, ask if he’ll come back to look into the defect listed.You should also ask the seller for additional information about the cause of the defect and for the name of the person or company that made repairs to the home. Contact the repair company to determine what was done and what is the likelihood that the problem will return. Ask if there is something further the seller could have done to correct the problem. If you close on the home knowing it has a defect and there is a recurrence, you’ll have to pick up the cost of the repair, and probably won’t have any recourse against the seller. That’s more than Hollywood takes in at the box office.A TV ad I’ve seen recently for artificial knees and hips made by Smith & Nephew, a British medical technology company, may help explain why we spend so much on these implants. It is not the kind of ho-hum ad we now see so regularly, urging us to seek relief from a disease we’ve never heard of by taking a pill with so many side effects it takes the pitchman half the air time to recite them. Instead, Smith & Nephew’s ads look more like a pitch for Nike.Here’s how the ads are described in an article I found on the website of a trade publication, Pharmaceutical Executive:A gray silhouette moves seamlessly, flowing like ink through water — swimming, golfing, playing tennis. The only discernable, solid characteristics in these figures in motion are the hip and knee replacement devices from Smith & Nephew. Chief creative officer Jonathan Isaacs and group account director Ann Woodward from Ogilvy Healthworld, part of Ogilvy CommonHealth Worldwide, are two of the many creative people who took part in developing the ad campaign for Smith & Nephew hip and knee replacement products, encouraging patients to “rediscover their go.”This DTC [Direct to Consumer] campaign manifested as TV spots aimed to showcase joint replacement devices in a nonconventional way, delivering the message that “this isn’t your grandfather’s hip,” according to Isaacs. “I think we tried to do something that felt much more state-of-the-art. This literally is the next generation of hip and knee replacement.”Given how much we spend on these devices, including the money spent by Medicare for seniors who opt for them, I’d like to see an article that explores whether these ads create demand rather than shift market share among manufacturers. What do Smith & Nephew’s reports to stock analysts, or even its own internal reports, say about whether the ads are a good return on investment and are creating demand?When did these commercials start running? (There have apparently been ads like this on U.S. TV for at least the last five years, but they seem more prevalent lately.) What is the ad budget? And what are the profit margins on the company’s knees and hips?I know from my on the outsized U.S. healthcare costs that Americans buy artificial hips and knees at far higher rates per capita than patients in any other country. Is this one of the reasons?The last paragraph of the celebratory Pharmaceutical Executive article seems to imply that creating demand is exactly the goal:Another differentiating factor for the Smith & Nephew campaign was that it aimed to reach a broader audience. … We were trying to make the point that anybody who is active can create wear and tear on their bodies, and there are a lot of folks — young and old — that can need joint replacement,” Isaacs says.Is this kind of television advertising allowed in other countries? I’m not in favor of the government prohibiting speech, even corporate speech — especially speech that presents a choice that people can make.But reporting that pins down what we might be paying for that speech would contribute to the debate over whether what is often an optional medical choice should be protected by the same kind of insurance the covers medical necessities.Failing your way on to TV:Many may only know Marcia Clark as a name appearing in recent weeks under an attractive brunette talking head who has been opining on television about defense and prosecution strategy in the case of George Zimmerman, the man accused of murdering teenager Trayvon Martin. As she critiques each side’s strategy, Clark is typically described as a former prosecutor and expert legal analyst. That’s like describing the captain of the Titanic as a former cruise ship captain or nautical expert.For Clark was the lead prosecutor who lost what may have been the highest profile — and, more important, easiest to win — murder case of the last century: The O.J. Simpson trial 18 years ago.So why can’t a television or legal reporter use Clark’s popularity as an expert analyst as an opening to ask TV producers if there is anything other than fame (and good looks) that goes into decisions about whom to book for these appearances discussing Zimmerman and other cases?A related topic would be describing how obsessive some lawyers are about getting on to these shows, hoping to attract clients who might be drawn to someone who’s not only famous for being on TV but famous for being an expert legal analyst. Does it work to build not only to build their egos but also their practices?As someone who supervised the TV booking of lawyers in the early days of Court TV, I know that many of the best lawyers avoided these TV appearances for a lot of reasons, not the least of which is that they’re too busy actually practicing law. But others craved the camera even if they don’t need new clients. One morning in the middle of the Simpson trial, one of the country’s busiest divorce lawyers, who had never handled a criminal case, was sitting in my reception area waiting for me so that he could try to talk his way onto the air to critique Clark’s performance.Do publishers think Paula Deen is worse than Hitler?One of the more curious aspects of the implosion of celebrity chef Paula Deen last week was the way her book publisher, Random House, announced that it had cancelled plans to publish her new cookbook this fall despite the fact that the book had so many advance orders that it soared to the top of the Amazon best seller list the same week.That major consumer businesses may want to disassociate themselves quickly from someone whose public comments suggest that he or she is a racist is understandable. But isn’t book publishing different?Right now you can click over from reading this and go to Amazon or the Apple book store and buy what seem to be four different versions of Adolf Hitler’s Mein Kampf, including a Kindle edition from Amazon and an iPad edition from Apple.In fact, Houghton Mifflin, which, like Random House, is a leading publisher, was apparently the first bookseller to bring Hitler’s long, virulent rant to the United States. Detroit Institute of ArtsHearing that the official hired to sort out Detroit’s financial mess has asked for a of the celebrated in the Detroit Institute of Arts, perhaps with a view to selling off its , , , and the rest, brought to mind remarks by former British Prime Minister Harold Macmillan about then-Prime Minister Margaret Thatcher’s privatization program.“It is very common with individuals or estates when they run into financial difficulties to find that they have to sell some of their assets,” in his inimitable aristocratic drawl. “First the Georgian silver goes. Then all that nice furniture that used to be in the saloon. Then the Canalettos go.” Finally, even the “two Rembrandts that were still left” are put under the hammer.Detroit is bust and about $11 billion in debt. The city owns the DIA and its fine collection of art, which is priceless. Estimating the value of such a cache of world-renowned pictures and sculptures is impossible as all its masterpieces are unique. Nonetheless, some guess a fire sale would raise about $2.5 billion.The man charged with balancing the books it is premature to talk of selling the art, but claims city creditors, who will be asked to take cents on the dollar in lieu of what is owed them, are bound to demand that all the city’s assets, including the DIA collection, are sold before they will agree terms. Phooey! To send in the appraisers is to invite creditors to demand the sale.There are a number of significant practical details about selling a large public art trove. Under the federal bankruptcy code’s Chapter 9, neither a judge nor creditors can force the city to sell its assets, so another prolonged and expensive legal battle would likely ensue. A 2012 tax millage, in which residents in three Detroit neighborhoods agreed to pay extra taxes to support the collection, may have to be rescinded.There can also be stiff legal inhibitions against a sale in the donors’ deeds, which would entail elaborate and costly court hearings to unpick. That happened at the , in Waltham, Massachusetts, in a between its owner, Brandeis University, and art donors over the of its important modern art collection, including paintings by Jasper Johns, Roy Lichtenstein and Robert Rauschenberg. That dispute was only just settled after four expensive years, with the university abandoning the effort to sell its art, which has been described as “the finest of such collections in New England,” to pay down its debt.There is a problem, too, about dumping too many high-quality pictures like Van Gogh’s , Brueghel’s and Matisse’s onto the market at the same time. Even more troubling, for it would also entail destroying the integrity of the DIA’s building, would be the removal of the extensive mural cycle by , which he painted to adorn the museum’s lobby.To maximize the price, the city would have to drip-feed the collection to the auctioneers to give private collectors and art museums time to collect their breath – and find the asking price. It would be anything but a quick fix.Practicalities aside, does it make good financial sense? If you want to pay down debt without delay and can gain legal access to the pictures, selling off what Macmillan called “the family silver” has its attractions. Like gold, you might argue that important and rare pictures and sculptures are “stores of value” to be cashed in at times of need.However, even if the estimates reflect only half the money that may be raised, it is only going to provide half the money the city needs to become solvent. If there were no other considerations apart from monetary, however, putting a collection of publicly owned art up for auction would be a sure, if undignified, way of raising cash.Economically, however, it would be a disaster. Art is not like gold, which has few uses except as a store of value. Sell gold and you can buy back gold. Sell rare masterpieces and they can rarely, if ever, be recovered. Fine art has a value way beyond its mere price. To liquidate the DIA’s art would be a short-term fix that would soon redound on those who say they have Detroit’s best interests at heart.Imagine if Greece, with all its financial difficulties, sold off the Acropolis. Or if the Madrid government auctioned the treasures of the Prado. Or Italy pillaged its classical and Renaissance inheritance to fix a temporary lack of funds. It would destroy overnight the tourist trade that provides such a sure source of revenue and would destroy the politicians who dare sign off on such a cheap, shortsighted deal. Even repo woman Angela Merkel, the German chancellor, has not yet suggested plundering the Mediterranean countries’ cultural monuments to gain her pound of flesh.If Detroit is to survive well into the 21st century the city must attract the best and the brightest. A vibrant arts community is already developing. Highly talented and skilled people will only be tempted to relocate to Michigan and meet the challenge of reviving the city’s fortunes if they feel they are moving to a sophisticated metropolis that can match their high aspirations. Few aspects of a city more accurately reflect the quality of life that can be achieved than the excellence of its public art.To sell off the DIA’s collection in a hurriedly arranged fire sale would send a clear signal that Detroit is washed up, a dead end, an urban experiment that did not survive the rigors of the market. Could Detroit endure a long and virulent campaign by art lovers all over America portraying the Motor City as the broken-backed capital of philistinism? Investors would conclude that Detroit is finished and take their money elsewhere.Once the art is gone, even if only the most valuable works are sold, the DIA will find it impossible to attract high quality art experts, museum administrators and donors. Why would they bother to contribute to a sinking venture? The DIA collection, an acknowledged jewel among America’s top art museums, will become a tragic memory, like New York’s demolished Penn Station — a constant reminder of a wrong turn taken by unimaginative philistines.It is not only the economics of a sale that makes little sense. Art collections are a social good, a notion seldom taken into account by economists of the worst kind who too often appear to know the price of everything and the value of nothing. Art enhances the dignity of a community, educates its citizens and provides pleasure and entertainment that directly appeals to the mind and the senses.You need only fight the crowds in any major art museum at weekends to see that the appreciation of art has become as important to many as an act of worship. Indeed, to some the adulation of art and artists has become an inspiration to an enhanced spiritual life.Are there lessons for other cities in Detroit’s dilemma? Yes. If Detroit gets this wrong it may earn a place in history as the first city to condemn itself to a lingering death because of a failure to understand the value of art to its residents.
