The standard definition of Non-Resident Indian is a citizen of India who holds an Indian Passport and has temporarily emigrated to other countries for 180 days or more for employment, education or any other purpose.

No, your son will not be considered as Non-Resident Indian as they are residing within the territory of India.

A student can continue studies after class 8 in India.

Student will be considered NRI because neither his place of birth is India, nor he had spend more than 90 days in India.

Your son is considered as local student.

A person holding Indian passport is considered NRI(Non-Resident Indian), when he/she leaves out of India for a period of more than 182 days for education, employment, residence or any other reason.

Since your son has lived out of India for more than 182 days, he will be considered as NRI student.
