I joined in a psu as a clerk and later on promoted to/got job in another psu as an officer. Now my annual income is more than rs.4.5 lakhs.

Now it may be clariefied to me that am i eligible for getting obc non-creamy layer certificate or not? My child who is going to complete graduation in this year. Kindly clarify whether my child is eligible to apply in obc category for higher studies.

My child is studying for llm. Our OBC annual income is Rs. 3.6 lakhs. Is she eligible for PSC job in Kerala under OBC reservation

My Annual income from last three year is 13,65,000
Year 2010-11 = 6,00,000/-
Year 2009-10 = 4,50,000/-
Year 2008-09 = 3,15,000/-

Should i get the benifit in OBC catogary for my child to FE Engg. 2011 year 50% tution fee concesion in engineering college?

if my average income for three years
2008-09 ,2009-10, 2010-2011 is average about 5 lakhs can i get 50% concession in engineering degree course in maharashtra

Clarifications (Explanation) regarding Clause VI (a) of Creamy layer criteria( Income Limit) amongst OBCs

As per Clause VI (a) of Creamy layer criteria “Persons having gross annual income of Rs. 4.50 lakh or above for a period of three consecutive years or possessing wealth above the exemption limit as prescribed in the Wealth Act for a period of three consecutive years will be treated as creamy layer.

According to Mr.Shailendra Wagadre (www.obcguru.com) interpretation of the above clause is follows:

Here the word “for a period of three consecutive years” is important . According to it from last 3 financial years , if the income of any one financial year is less then Rs. 4.50 lakh then the family will not come under creamy layer and get the reservation.
For eg. ,
Year Family Income

2008-2009 2,00,000.00 Rs.
2009-2010 4,60,000.00 Rs.
2010-2011 5,60,000.00 Rs.

As per my interpretation , a person , with annual income ( business income” ) as per above mentioned years for three consecutive years does not come under creamy layer as his income for one of the three consecutive year is less than Rs. 4.5 lakh/annum (viz. Rs.2,00,000 in 2008-2009).

yes your are not come uder the creamy layer because your annual ofyear 2010_09 and 2009-08 less than 4.5 lakh this for every idividual year

TOTAL DEDUCTION EVERY MONTH=10720
NET PAY=28615(TAKE HOME).....
noncreamy limit is 4,50,000.... in this case which pay should be calculated. either gross pay or net pay ?
gross pay=>39335*12 = 4,72,020
net pay =>28615*12 = 3,43,380.

Now annual income limit is enhanced to six lakhs instead of rs.4.5 lakhs.
Creamy layer limit is applicable for Category-II(A) , Category-III(A) ,Category-III(B). But creamy layer is not applicable for casts come under SC , ST and Category-I.
